Moss & Barnett Obtains Defense Verdict in Multi-Million Dollar Accounting Negligence CaseMoss & Barnett is pleased to announce that a jury in Billings, Montana, returned a defense verdict on June 9, 2009, in Western Security State Bank v. CPA Firm, Yellowstone County District Court File No. DV 07-1463, a case in which an asset-based lender claimed that outside auditors negligently failed to discover the misappropriation by the borrower of the bank's collateral. The bank claimed damages of $6.5 million, but will recover nothing as a result of the jury's verdict. The case was tried for the defense by Moss & Barnett attorney, Thomas J. Shroyer, with the assistance of his partner, Peter A. Koller, and with the assistance of local counsel, W. Andrew Forsythe of the Moulton Bellingham PC firm located in Billings, Montana. The plaintiff was represented by Holland & Hart, an AmLaw200 firm with headquarters in Denver, Colorado.
